Attorney Fees

The contract between the lawyer and his or her client about the payment of fees is called a fee agreement .
In addition to the attorney's charges for time, litigation involves costs for expert witnesses, photocopies, transcripts, travel and other "hard costs". Fees should be discussed with us, up-front,
preferably during the initial contact*.



There are three basic types of payment plans (fee agreements) for the attorney services:
Time charges - hours X rate
Flat Fee - agreed amount no matter how long it takes
► Contingent fee - % of amount recovered (amount paid by defendant)

All fee agreements are one or a combination of these payment plans.

All fee agreements are negotiable. Our normal rate for hourly work varies between $300 and $400 an hour, which is about median rates for specialty firms in California. Our contingency percentage rate varies by the type of case, usually between 33.33 % and 40%.  If an attorney pays the costs of the lawsuit, those costs are reimbursed to the attorney before the remainder of the amount recovered is distributed to the class and the attorneys.

For class action lawsuits, attorney's fees are part of the settlement or verdict, and are subject to judicial review for fairness. The Court may approved a small additional compensation to the Class Action Representatives (the named plaintiffs) for their individual claims and for work on the case greater that the rest of the class.
